Overview

This website is operated under the Desk Guts retail brand. Desk Guts is a retail brand of First 3 Then Me LLC, an Illinois limited liability company. Throughout this website, the terms “Desk Guts,” “we,” “us,” and “our” refer to First 3 Then Me LLC operating the Desk Guts retail brand.

By visiting our website, purchasing a product, creating an account, submitting content, or otherwise using our services, you agree to these Terms of Service and any additional policies referenced on this website, including our Return and Refund Policy, Privacy Policy, and Shipping Policy.

If you do not agree with these Terms, please do not use the website or services.

1. Online Store Terms

You must be legally permitted to make purchases using the payment method you provide.

You may not use our products, website, or services for any unlawful or unauthorized purpose or violate any applicable laws while using the site.

We reserve the right to refuse service, cancel transactions, or restrict access when reasonably necessary to protect customers, our business, or the security and integrity of the website.

2. Products and Product Information

Desk Guts offers teacher supplies, classroom products, apparel, books, stationery, gifts, accessories, educational products, and other merchandise.

We make reasonable efforts to display product descriptions, photographs, colors, dimensions, and other details accurately. However, colors and appearance may vary based on your device, manufacturer, production run, or supplier.

Some products sold through Desk Guts are produced, stocked, or fulfilled by independent suppliers. Product packaging may therefore vary from photographs shown on the website.

We reserve the right to add, modify, discontinue, or limit products at any time.

3. Pricing

Prices are displayed in U.S. dollars unless otherwise stated.

We may change prices at any time without advance notice. A price change will not affect an order that has already been completed and accepted.

Applicable sales taxes, shipping charges, or other charges will be displayed during checkout when required.

If a product is accidentally listed at an incorrect price because of a technical, supplier, or data-entry error, we reserve the right to cancel the affected order and issue a refund.

4. Orders

Submitting an order does not guarantee acceptance.

We reserve the right to cancel or limit an order for reasons including suspected fraud, payment problems, inventory errors, supplier availability, pricing errors, shipping restrictions, or other circumstances that prevent reasonable fulfillment.

If we cancel an order after payment has been processed, the appropriate amount will be refunded to the original payment method.

Customers are responsible for providing complete and accurate billing, shipping, and contact information.

5. Payment

Payments are processed through Shopify and its authorized payment providers.

By submitting payment information, you represent that you are authorized to use the payment method provided and authorize the applicable charges associated with your order.

Desk Guts does not directly store complete payment-card information.

6. Shipping and Fulfillment

Desk Guts works with multiple suppliers and fulfillment partners. As a result, products within the same order may:

ship from different locations;
arrive in separate packages;
have different processing times; or
arrive on different dates.

Estimated delivery times are estimates and are not guarantees.

Once an order ships, tracking information will generally be provided electronically when tracking is available from the fulfillment provider.

Delivery delays caused by carriers, weather, incorrect customer information, customs, supplier disruptions, or circumstances outside our reasonable control do not constitute a breach of these Terms.

7. Returns, Refunds, and Cancellations

Returns and refunds are governed by the Desk Guts Return and Refund Policy.

Because products may be fulfilled by different suppliers, customers must contact Desk Guts before returning merchandise. Do not send a product to an address shown on its packaging unless Desk Guts has specifically confirmed that return address.

Requests to cancel orders should be made as soon as possible. Some orders are transmitted automatically to fulfillment partners, so cancellation cannot be guaranteed after fulfillment has begun.

8. Promotions, Discounts, Store Credit, and Rewards

Desk Guts may offer promotional codes, store credit, contributor incentives, gifts, discounts, or other rewards.

Unless otherwise stated:

promotions have no cash value;
discounts cannot be combined if the promotion states otherwise;
store credit is redeemable only through Desk Guts;
promotional offers may be modified or discontinued; and
misuse or fraudulent use of promotional programs may result in cancellation of the associated benefit.

Additional terms may apply to individual promotions.

9. Reviews and Teacher-Contributed Content

Desk Guts may allow customers, educators, ambassadors, or other users to submit reviews, photographs, classroom ideas, activities, lesson suggestions, comments, or other content.

You retain ownership of original content that you create. By voluntarily submitting content for publication, you grant First 3 Then Me LLC a nonexclusive, worldwide, royalty-free license to reproduce, display, format, edit for clarity or length, distribute, and promote that submitted content in connection with Desk Guts.

We will not knowingly represent contributor-submitted material as having been created by Desk Guts.

You represent that content you submit is yours to share or that you have the necessary permission to share it.

We may decline, remove, or edit submissions that are unlawful, abusive, misleading, infringing, irrelevant, or otherwise inappropriate for the site.

Receiving a product, discount, credit, or other benefit in connection with content does not guarantee publication or require a positive review unless explicitly stated otherwise.

10. Intellectual Property

Unless otherwise indicated, the Desk Guts name, branding, original website content, graphics, written materials, product concepts, and other original content belonging to First 3 Then Me LLC are protected by applicable intellectual-property laws.

Third-party product names, trademarks, photographs, books, designs, and other materials remain the property of their respective owners.

Nothing on this website grants users permission to reproduce, commercially distribute, or exploit protected content except as expressly permitted.

Some products and services available through Desk Guts may originate from independent manufacturers, publishers, suppliers, fulfillment providers, technology providers, or other third parties.

We do not control every aspect of third-party operations. However, Desk Guts remains the customer-facing retailer for purchases made directly through deskguts.com.

Third-party websites linked from our site may have their own terms, policies, and privacy practices. We are not responsible for content or practices on websites we do not operate.
